Introduction
1The applicant filed an Application on August 27, 2013 alleging that the respondent discriminated against her because of disability when it terminated her employment.
2In its Response filed October 21, 2013 the respondent requested that the Tribunal dismiss the Application on the basis that the applicant had signed a full and final release with respect to the issues raised in the Application. The respondent attached to its Response a letter offering the applicant termination and severance pay in return for a signed full and final release. Both the letter and the release were signed by the applicant.
3On November 7, 2013 the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the applicant has signed a full and final release with respect to the issues raised in the Application. The applicant was directed to respond to the NOID by no later than November 21, 2013. The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason.
4The applicant has not responded to the NOID and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
