Pascal Adorgloh Applicant
-and-
Seasons Foodmart and Fen Lin Respondents
DECISION
Adjudicator: Jennifer Scott Date: November 26, 2013 Citation: 2013 HRTO 1955 Indexed as: Adorgloh v. Seasons Foodmart
1The applicant filed a Contravention of Settlement Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on September 3, 2013.
2On September 30, 2013, the Tribunal wrote to the applicant to clarify whether or not an alleged breach of the Minutes of Settlement had occurred as the Application alleged the respondents had failed to comply with a final decision of the Tribunal, not Minutes of Settlement. The applicant was directed to clarify whether a breach of Minutes of Settlement had occurred, as well as his intentions with respect to proceeding with the Application, within 14 days of the September 30, 2013 letter. The Tribunal advised the applicant that if he failed to respond within that time period, the Application may be considered abandoned and the file may be closed.
3The applicant has not responded to the Tribunal’s letter of September 30, 2013 and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 26th day of November, 2013.
