1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on July 8, 2013, and the respondent filed a Response on September 6, 2013. A mediation was scheduled for November 6, 2013, in Ottawa.
2Although both parties indicated their agreement to attend mediation, the applicant withdrew his agreement on November 1, 2013 because the respondents indicated their intention to participate in the mediation by conference call. The applicant advised the Tribunal that if the respondents did not have the decency to talk to him in person, he wanted nothing more to do with this.
3By correspondence dated November 12, 2013, the Tribunal directed the applicant to advise the Tribunal and the respondents in writing whether he intended to proceed with the Application by November 18, 2013. The Tribunal advised the applicant that if he did not respond by November 18, 2013, the Tribunal may deem the Application to be abandoned and dismiss the file. The applicant has not responded to the Tribunal’s correspondence of November 12, 2013.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
