Introduction
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment on the basis of race and ethnic origin. This Interim Decision addresses the applicant’s request to remove a named personal respondent and to add a personal respondent.
2The Application was filed on September 6, 2013, naming Dr. Robert Weber and Ms. Nancy Khabiri as respondents. On September 27, 2013, the applicant filed two Requests for an Order During Proceedings (“RFOP”); the first requesting that Nancy Khabiri be removed as a personal respondent and the second requesting that Ms. Heather Peco be added as a personal respondent. The RFOPs state that the applicant made an administrative error on the Application when she identified Nancy Khabiri as a respondent and that her intention was to name Heather Peco as a respondent.
3None of the named respondents have filed responses to the applicant’s RFOPs. However, both Robert Weber and Heather Peco filed individual Responses to the Application in October 2013.
DECISION
4I am satisfied, based on the applicant’s RFOPs and a review of the narrative contained in the Application, that the applicant mistakenly named Nancy Khabiri as a personal respondent and that she wishes to remove her as a respondent. Therefore, the Tribunal orders Nancy Khabiri to be removed as a personal respondent and the style of cause is amended accordingly.
5I am satisfied, based on the applicant’s RFOPs that the applicant wishes to name Heather Peco and that there is no objection to this request given that Robert Weber and Heather Peco have subsequently filed Responses. Therefore, the Tribunal orders Heather Peco to be added as a respondent and the style of cause is amended accordingly.
6As all parties have agreed to mediation this matter will be scheduled for mediation.
