1This Application was filed on May 28, 2012. It alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2In her Application, the applicant indicates that she had suffered a work-related injury and was involved in a proceeding before the Workplace Safety and Insurance Board ("WSIB"). By Interim Decision dated July 4, 2012, 2012 HRTO 1323 the Tribunal deferred this Application pending the conclusion of the applicant's appeal to the Appeals Resolution Officer ("ARO") of the decision denying the applicant entitlement to benefits after September 2011.
3The applicant filed a Request for Order to reactivate her Application on October 18, 2013. She attached a copy of the ARO decision, which was released on September 27, 2013.
4Although the Request to reactivate this Application was delivered to the respondent at that time, the respondent did not file any response submissions with the Tribunal and the time for so doing has now passed.
5In the circumstances, the request to proceed is appropriate and is granted. This matter will proceed to mediation and, if necessary, a hearing before this Tribunal.
6I am not seized of this matter.
