1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2In an earlier Interim Decision in this matter, 2013 HRTO 1555, the Tribunal ordered, amongst other things, the applicant to provide particulars regarding one of the allegations of systemic discrimination set out in her Application. On October 2, 2013, the applicant filed submissions indicating that she is withdrawing her claims of systemic discrimination in order to protect the privacy of her colleagues. The Applicant also filed a Request for an Order During Proceedings (the “Request”) in which she requested removal of the individual respondents and indicated that the respondents consented to the request. The respondents did not file a Response to Request for Order.
Decision
3The applicant did not file a Request to Withdraw (Form 9) regarding her systemic claims, but I am satisfied that the applicant’s submissions amount to a Request to Withdraw for the purposes of Rule 10, Withdrawal of an Application, of the Tribunal’s Rules of Procedure. The respondent did not respond to this request and the time for doing so has passed. Accordingly, the applicant’s allegations of systemic discrimination are withdrawn and particulars regarding these allegations are no longer required.
4The applicant’s Request to remove the individual respondents is unopposed and I see no reason not to grant it.
Order
5The Tribunal orders as follows:
The allegations of systemic discrimination are withdrawn and particulars regarding these allegations are not required; and,
The individual respondents are removed from the Application and the style of cause amended accordingly.
