1This Decision is further to the Tribunal’s Interim Decision 2013 HRTO 1487 dated September 3, 2013.
2In that Interim Decision, I refused the applicant’s request to add allegations and expand the scope of his Application, and directed submissions from the parties on how they proposed to proceed in view of the ruling. By letter dated September 23, 2013, counsel for the applicant advised that the applicant wished to proceed, and that “the application which he wishes to pursue is that which the Chair has refused to allow to proceed.” The letter goes on to ask that the matter be finally determined so the applicant can file a Request for Reconsideration.
3By letter dated October 3, 2013, the respondent requested the Application be dismissed as having no reasonable prospect of success, or disclosing no prima facie case.
4The applicant indicates that he wishes the Application to proceed and a final determination issued. He does not propose to call any evidence or make any further submissions. He states that he wishes to proceed on the allegations that I have ruled inadmissible.
5In view of the above, the Application is dismissed.
