1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of sex and family status.
2In her Application, the applicant indicated that she had filed a claim with the Ministry of Labour against the respondent Hazmasters, alleging a contravention of the Employment Standards Act, 2000, with respect to the same allegations which form the basis of her Application.
3On July 30, 2013, the Tribunal issued a Notice of Intent to Defer ("NOID") the Application and inviting the parties to make submissions as to why or why not the consideration of the Application should, or should not, be deferred.
4On September 24, 2013, the applicant wrote to the Tribunal, advising that she had withdrawn her claim at the Ministry of Labour and providing a copy of correspondence from the Ministry of Labour confirming the withdrawal.
5None of the other parties filed submissions at the Tribunal regarding this issue.
6In view of the fact that there is no longer another legal proceeding dealing with the subject matter of this Application, and therefore no other proceedings to which it would be appropriate to defer this Application, this Application will be continued in the Tribunal's process.
7I am not seized.
