1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On October 12, 2010, the Tribunal issued Interim Decision, 2010 HRTO 2070, deferring this Application pursuant to Rule 14 of its Rules of Procedure pending the completion of a union grievance.
3By letter dated September 24, 2013, the Tribunal directed the applicant to advise the Tribunal whether the union grievance is still ongoing and, if possible, when it is expected to be completed, within 30 days of the date of the letter, i.e., October 24, 2013. The letter warned the applicant that the Tribunal may dismiss the Application as abandoned if she failed to respond as directed.
4As of the date of this Decision, the applicant has not responded to the Tribunal’s direction. In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
