1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to services because of sex and sexual solicitation. Reprisal is also alleged.

2In a Case Assessment Direction ("CAD") dated July 26, 2013 the applicant was directed to provide submissions on whether the Tribunal had jurisdiction with respect to two of the three respondents. The CAD warned the applicant to file his submissions within the time frame set out by the Tribunal or risk having his Application dismissed. He did not file any submissions.

3After the deadline passed the applicant contacted the Tribunal by phone to advise of his current address. He also notified the Tribunal that he would be moving and would provide his new address when he moved. As a result the Tribunal sent him a letter on October 3, 2013 telling him again to file submissions on the CAD, this time by October 14, 2013, or face having his Application dismissed.

4No submissions have been filed by the applicant and the time for doing so has now passed. There is nothing to indicate that the Tribunal's October 3, 2013 was not received by the applicant. Having regard to the fact that the applicant was notified of the possible consequence of not filing submissions in accordance with the CAD, and the fact that he has not complied with the Tribunal's direction, I determine that he has abandoned his Application.
