1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on January 29, 2013.
2On June 12, 2013, the Ministry and the Ontario Lottery and Gaming Corporation respondents delivered and filed a Request for Summary Hearing.
3On October 7, 2013 the Tribunal issued a Case Assessment Direction (“CAD”), noting that the applicant did not file a Response (Form 11) to the Request for Summary Hearing. The Tribunal directed the applicant to provide a Response to the Request for Summary Hearing, together with an explanation for his failure to do so in a timely way, within 7 days of the date of the CAD. The Tribunal indicated that a failure to comply with the Tribunal’s directions may result in the Application being dismissed as abandoned.
4The applicant has not responded to the Tribunal’s CAD and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
