DECISION
Adjudicator: Brian Eyolfson Date: October 28, 2013 Citation: 2013 HRTO 1814 Indexed as: Botrie v. OSC Constructors
1These Applications, Tribunal file numbers 2013-13600-I and 2013-13681-I, were filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on February 1 and February 12, 2013, respectively.
2On August 21, 2013 the Tribunal issued a Case Assessment Direction (“CAD”) directing the parties in both Applications to file their positions and submissions with respect to the consolidation of the Applications, within 15 days of the date of the CAD. None of the parties complied with the Tribunal’s directions.
3On September 25, 2013, the Tribunal sent a second CAD to the parties, directing the applicants to comply with the directions set out in the Tribunal’s August 21, 2013 CAD. The Tribunal indicated that if the applicants did not comply with the Tribunal’s directions within 14 days of the date of the CAD, the Applications may be dismissed as abandoned.
4The applicants have not responded to the Tribunal’s CAD and the time for doing so has now passed.
5In the circumstances, the applicants are deemed to have abandoned the Applications.
6The Applications are dismissed.
Dated at Toronto, this 28th day of October, 2013.
