DECISION
Adjudicator: Jo-Anne Pickel Date: October 23, 2013 Citation: 2013 HRTO 1785 Indexed as: Hassan v. Toronto Police Service
Introduction
1This decision addresses the applicant’s failure to provide accurate information for the respondent.
2The applicant filed an Application June 7, 2013. The Tribunal had to issue multiple Notices of incomplete Application as the applicant consistently failed to provide all the information required to process his Application. In response to these Notices, the applicant named various organizational respondents including the Royal Canadian Mounted Police, the Toronto Police, “DPP”, “CSCI and “Canadian Security”. He also named a police officer named “Ahmed”. He failed to provide a last name for this individual and instead referred to him as “rat”, “pig” and “crackhead”.
3By Case Assessment Direction (“CAD”) dated September 25, 2013, the Tribunal directed the applicant to confirm exactly which organizational respondent(s) he claimed to be responsible for the discrimination alleged in the Application. The Tribunal also directed the applicant to provide a full name for the officer identified as “Ahmed”. The Tribunal advised the applicant that, if he failed to provide this information within 14 days of the date of the CAD, his Application could be dismissed.
4The applicant has failed to provide the information required in the CAD and the time to do so has elapsed.
5In filing an Application with the Tribunal, an applicant is commencing a legal proceeding. Therefore, applicants have a responsibility to take the process seriously and provide the necessary information for the processing of their Application. It is the responsibility of the applicant to provide accurate contact information. See, for example, Guild v. Kyle-Jansen, 2008 HRTO 347 and Osman v. Elle Productions Security, 2009 HRTO 1426.
6In the above circumstances, the Application is dismissed as abandoned. Despite several requests to do so, the applicant has failed to provide and/or confirm the information necessary to process his Application.
Dated at Toronto, this 23rd day of October, 2013.
