1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"), in which the applicant alleged that the respondent infringed her rights under the Code.
2In early March 2013, counsel for the applicant advised the Tribunal that the applicant had passed away in January 2013. Accordingly, by Interim Decision dated June 5, 2013, 2013 HRTO 999, the Tribunal directed that the Application be held in abeyance until October 5, 2013, while the necessary steps were taken to appoint an estate trustee authorized to act on behalf of the applicant's estate.
3On October 3, 2013, counsel for the applicant wrote to the Tribunal to advise that, as the applicant's will did not appoint an estate trustee, the issue as to who is authorized to act on behalf of the estate remains unresolved. In the circumstances, he asks for a three-month extension to confirm who is authorized to act for the applicant's estate and to obtain instructions with respect to the Application.
4In my view, the request for an extension of time to confirm who is authorized to act on behalf of the applicant's estate is reasonable in the circumstances. Moreover, the respondent does not oppose the request. Accordingly, the request is granted.
5The Application will continue to be held in abeyance until January 5, 2014, while the necessary steps are taken to confirm who is authorized to act on behalf of the applicant's estate as the estate trustee. If the Tribunal receives no communication from the applicant's estate on or before January 5, 2014, the Application may be dismissed as abandoned.
