1On September 25, 2009, the applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, which alleged that the respondents discriminated against her with respect to employment because of her age. Specifically, she alleged that her long-term disability benefits were terminated at the age of 60 because of a provision in the collective agreement between the respondents.
2The Thunder Bay Police Services Board acknowledges that the collective agreement that was in force at that time had a provision on long-term disability benefits which was unintentionally discriminatory on the basis of age. The Thunder Bay Police Services Board states that it has subsequently reached a new collective agreement with the Thunder Bay Police Association, which has a non-discriminatory provision with respect to long-term disability benefits.
3The parties agree that they have resolved the Application to their mutual satisfaction. The Tribunal therefore disposes of this Application.
