DECISION
Adjudicator: Ruth Carey
Indexed as: Whyet v. Hollywood on the Queensway
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on June 20, 2012.
2On September 23, 2013, the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to file with the Tribunal the materials required pursuant to Rules 16 and 17 of the Tribunal’s Rules of Procedure no later than 7 days from the date of the CAD. The CAD stated that if the applicant failed to file the materials by the required deadline the Tribunal might consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
3The applicant has not responded to the CAD and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 15th day of October, 2013.
