HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Brandon Guay and Tyler McLachlan Applicant
-and-
Elly-Mae Small Respondent
DECISION
Adjudicator: Brian Cook Date: October 11, 2013 Citation: 2013 HRTO 1723 Indexed as: Guay and McLachlan v. Elly-Mae Small
APPEARANCES
Brandon Guay, Applicant Self-represented
Tyler McLachlan, Applicant Self-represented
Elly-Mae Small, Respondent Self-represented
1These two Applications were filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2Following a telephone case conference hearing it appeared that the parties had agreed to a settlement of the Application. The Tribunal did not receive a Tribunal settlement form (Form 25). The Tribunal issued a Case Assessment Direction on August 14, 2013 asking the applicants to clarify if they wished to have the Applications proceed to hearing or if they wished any further assistance with settlement discussions. The Case Assessment Direction indicated that if the Tribunal did not hear from the applicants by August 23, 2013, the Applications could be dismissed as abandoned.
3The Tribunal has not received any communication from the applicants since the Case Assessment Direction was issued and it appears that the applicants do not wish to pursue the Applications further.
4The Applications are dismissed as abandoned.
Dated at Toronto, this 11th day of October, 2013.
