Adjudicator: Brian Eyolfson Decision Date: October 10, 2013 Citation: 2013 HRTO 1709 Indexed as: Jaffer v. Boehmer Box LP
The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, on November 15, 2012.
On August 12, 2013, the Tribunal sent an email to the applicant directing that he provide the Tribunal with dates for rescheduling the hearing in this matter by August 19, 2013. The applicant did not respond to the Tribunal’s direction.
The Tribunal sent a further email to the applicant on August 21, 2013, directing that he provide dates for rescheduling the hearing by August 26, 2013. The applicant also did not respond to the Tribunal’s second direction.
On August 29, 2013, the Tribunal sent a letter to the applicant by email requiring that the applicant confirm his intentions with respect to the Application. The Tribunal’s letter advised the applicant that if he wished to proceed with the Application he must provide the Tribunal with dates for rescheduling the hearing. The applicant was also informed that if he did not respond to the Tribunal’s letter by September 9, 2013 the Application may be deemed to be abandoned and the file closed.
On September 16, 2013 further correspondence was sent to the applicant by both regular mail and email, and attaching a copy of the Tribunal’s August 29, 2013 letter to the applicant. The Tribunal’s September 16, 2013 correspondence once again requested that the applicant provide the Tribunal with dates for rescheduling the hearing, and indicated that if the applicant did not respond by September 26, 2013, the Tribunal may deem the Application to be abandoned and close the file.
To date, the applicant has not responded to any of the Tribunal’s correspondence referred to above.
In the circumstances, the applicant is deemed to have abandoned the Application.
The Application is dismissed.
Dated at Toronto, this 10th day of October, 2013.
