1This is an Interim Decision in respect of an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On May 23, 2013, counsel for the applicant filed a Request for an Order During Proceedings seeking leave to amend the Application. The respondents have been served with the Request, but have not responded, and the time for doing so has passed.
3The applicant requests an order amending his requested remedies so that they would include lost wages in the amount of $6,767.12 which he states he was only recently able to calculate on the basis of a difference in his earnings between when he worked without restricted duties and when he worked with them.
4The hearing is scheduled to begin November 18, 2013, which is relatively soon, but given that the Application had indicated that the monetary compensation the applicant seeks is “to be determined”, the requested amendment does not appear to raise issues of unfairness to the respondents.
5The applicant’s Request to amend the Application to include the seeking of $6,767.12 for lost wages is allowed.
