1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment.
2On August 21, 2013 the Tribunal issued a Notice of Intent to Defer the Application pending the conclusion of the grievance process initiated by the applicant pursuant to the Collective Agreement.
3All of the parties filed submissions acknowledging that the grievance has been withdrawn by the applicant and that there is therefore no basis to defer the Application.
4Having reviewed the matter and in light of the submissions of the parties, I find that the Application will not be deferred. The Tribunal will continue to process the Application.
ORDER
5The Tribunal orders:
a. The respondent is directed to file a Form 2 Response within 35 days of the date of this Interim Decision; and
b. If the Canadian Union of Public Employees wishes to participate in this matter then it must file a Form 5 Request to Intervene within 35 days of the date of this Interim Decision.
6I am not seized.
