1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2By Interim Decision dated September 11, 2012, the Tribunal deferred consideration of the Application, pending the completion of another proceeding, namely two grievances filed pursuant to the collective agreement between the applicant’s trade union and the respondent employer: 2012 HRTO 1722.
3On August 6, 2013, the applicant filed a Request to reactivate the Application on the basis that the grievance process in respect of his grievances had concluded in July 2013, with the union’s decision not to refer the grievances to arbitration.
4Neither the respondent nor the intervenor has responded to the Request to reactivate and the time for doing so has now passed.
5As the other proceeding to which the Tribunal deferred has now been completed, the applicant’s Request that the Application be reactivated is granted.
6In the Application and Response, the parties indicated their willingness to try mediation in this matter. Mediation is the next step in the Tribunal’s process. Accordingly, the Registrar will schedule mediation in this matter shortly.
