1On January 11, 2013 this Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability. The Application alleges a series of discriminatory incidents that took place from October to December of 2011.

2On August 8, 2013 the Tribunal issued a Case Assessment Direction (CAD) which required the applicant to provide submissions on whether the Application should be dismissed for delay. The CAD explained the criteria under the Code for determining whether an Application should be dismissed for delay. The applicant was directed to provide her submissions within twenty-one days of the date of the CAD, and was advised that if she failed to do so, the Tribunal could declare her Application abandoned.

3The applicant has not provided any submissions and the time for doing so has now passed.

4As the applicant has not responded to the Tribunal’s direction, despite being warned of the consequences of failing to do so, I determine that she has abandoned the Application.
