1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2On July 18, 2013 the Tribunal issued a Notice of intent to Dismiss this Application because it appeared to be outside of the Tribunal's jurisdiction being a claim of reprisal without any explanation for how the behaviour complained about related to any of the following: claiming or enforcing a right under the Code; instituting or participating in proceedings under the Code; or, refusing to infringe the right of another person under the Code [s. 8].
3The Tribunal made the following Directions at that time:
You must provide written submissions responding to the issues identified above. You must file your written submissions on or before August 17, 2013.
The HRTO will consider your submissions and may decide whether to dismiss your Application or provide further directions regarding the next steps in this proceeding. If you do not file written submissions by the required time the HRTO will make its decision based only on the information in your Application or may consider the failure to respond as an abandonment of your Application and dismiss the Application for that reason.
4On August 28, 2013 the Notice above was sent to the applicant by email. At that time the Tribunal directed that the applicant file her submissions if on or before September 4. 2013 failing which the Application may be dismissed as abandoned.
5The applicant has not responded to these Directions in any manner whatsoever and appears to have abandoned the Application. The Application is accordingly dismissed as abandoned.
