Human Rights Tribunal of Ontario
B E T W E E N:
Kimberley Mann Applicant
-and-
Townshoes/The Shoe Company and Terry Tracey Respondents
INTERIM DECISION
Adjudicator: Jay Sengupta Date: September 16, 2013 Citation: 2013 HRTO 1548 Indexed as: Mann v. Townshoes/The Shoe Company
Introduction
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability.
2As a result of the respondents' failure to file a response, in an Interim Decision dated June 8, 2013 (2013 HRTO 1085), the Tribunal ordered that the respondents were deemed to have accepted all of the allegations set out in the Application and to have waived all rights to notice or participation in the proceedings.
3The respondents subsequently filed their Response and indicated that the document was previously submitted, without specifying when that was done. As the respondents now seek to participate in the proceedings, I have treated their correspondence as a request for reconsideration of the earlier Interim Decision, dated June 8, 2013. The Tribunal directed the applicant to make submissions with respect to the respondents' request. The applicant has not made any submissions and the time for her doing so has now elapsed.
4The respondents' request to participate in the proceedings is granted. The applicant may file a Reply in accordance with the Rules within 14 days of the date of this Interim Decision.
5I am not seized.
Dated at Toronto, this 16th day of September, 2013.
