1This is an Application filed on March 11, 2013 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment and reprisal.
2On June 11, 2013, the Tribunal delivered the Response to the applicant. The Tribunal stated that the applicant must file a Reply to the Response and a response to the Respondent’s Request for Order During Proceedings including complete submissions in response to the respondent’s request to dismiss (both in respect of delay and the claim of Federal jurisdiction) and attach any relevant documents.
3The applicant did not file a Reply or a Response to the Request for Order During Proceedings as directed.
4On July 11, 2013, the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to indicate in writing his intentions with respect to proceeding further with this Application by July 25, 2013 failing which the Application may be dismissed as abandoned.
5The applicant has not responded to the CAD and the time for doing so has now passed.
6In the circumstances, the applicant is deemed to have abandoned the Application.
7The Application is dismissed.
