1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, alleging discrimination with respect to services, goods and facilities on the basis of race, colour and ethnic origin and reprisal.
2By way of Interim Decision 2013 HRTO 46, the Application was deferred pending the completion of the court process related to events raised in the Application and underlying the applicant’s allegations.
3The applicant filed a Request for an Order During Proceedings dated June 13, 2013, requesting that the Application continue to remain deferred pending the disposition of his attempts to appeal his conviction. The applicant indicates that he was convicted in absentia.
4The respondent filed a response on June 19, 2013, indicating that they consent to the applicant’s request.
5Given that all parties agree that the Application should remain deferred pending the completion of the appeal regarding the related court proceedings, the Tribunal orders that the Application is deferred pending the completion of the appeal process.
ORDER
6The applicant’s request to defer the Application pending the completion of an appeal is granted.
7The Application will remain deferred. Where a party wishes to proceed with an application which has been deferred, the party must make a Request for an Order During Proceedings in accordance with Rule 19 within 60 days after the conclusion of the other proceeding (Rules 14.3 and 14.4).
