1This is a breach of settlement Application filed under the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), in which the applicant alleges that the respondent violated the terms of a settlement by filing an Application with this Tribunal, as the respondent had signed a release in the applicant’s favour.

2In my Decision dated June 25, 2013 (2013 HRTO 1122), I dismissed the Application filed by the respondent against the applicant as abandoned. I directed the applicant to advise the Tribunal and the respondent in writing within 14 calendar days as to whether she intended to proceed with her breach of settlement Application, together with written submissions as to the basis upon which she asserts that her Application can proceed. I stated that if nothing was received from the applicant within this time period, her breach of settlement Application would be dismissed as abandoned.

3It is now almost a month since the date of my previous Decision, and no communication has been received from the applicant or her counsel.

4Accordingly, the breach of settlement Application is dismissed as abandoned.
