1This is an Application filed on May 22, 2012 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination on the basis of disability in respect of employment. This Interim Decision deals with a Request to reactivate the Application.
2The Tribunal issued an Interim Decision, 2011 HRTO 203, deferring the Application pending the conclusion of an appeal under the Workplace Safety and Insurance Act, 1997, S.O. 1997, c. 16, Sch. A (“WSIA”). The applicant has filed a Request to re-activate the Application, stating that the WSIA appeal has concluded. The respondents did not file a response to the Request and the time for doing so has now passed. In the circumstances, I find that it is appropriate to re-activate this Application.
3The Request to re-activate the Application is granted.

4The respondents are directed to file their Response (Form 2) within 30 days of the date of this Interim Decision.
