1This Application was filed on April 11, 2013, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2On May 27, 2013, the respondent filed a Response to the Application, which the Tribunal delivered to the applicant on the same date. In its May 27, 2013 correspondence to the applicant, the Tribunal referred to Rule 9.1 of the Tribunal's Rules of Procedure which states as follows:
9.1. An Applicant who intends to prove a version of the facts different from those set out in a Response must deliver and file a Reply in Form 3 setting out the different version, unless it is already contained in the Application. An Applicant may also reply to any other matter raised in the Response.
3The applicant has not filed a Reply to the respondent's Response and was directed to do so in a Case Assessment Direction issued on June 24, 2013 failing which the Application might be dismissed as abandoned.
4The applicant did not comply with the Tribunal's Direction and has not filed a Reply although the time for doing so has passed. The applicant has made no contact with the Tribunal and appears to have abandoned this Application and accordingly it is dismissed.
