1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging reprisal and discrimination with respect to employment because of sex.
2A Notice of Hearing was delivered to the parties on April 29, 2013, informing them that the hearing date is September 30, 2013. The Notice informed the parties that they must send to each other all arguably relevant documents in their possession, and to the Tribunal proof that they have done so, by May 21, 2013. Only the respondents complied.
3By way of an Interim Decision, 2013 HRTO 1073, the Tribunal directed the applicant to comply with Rule 16.1 within 14 days and file proof that she delivered all arguably relevant documents to the respondents. The Interim Decision warned the applicant that if she did not comply, then the Tribunal might dismiss the Application as abandoned.
4The above Interim Decision was sent to the applicant on June 17, 2013 at the contact address she provided to the Tribunal on February 1, 2013. It has not been returned as undeliverable. The applicant’s deadline for complying with the Tribunal’s direction in that Interim Decision and with the Tribunal’s Rules of Procedure has now passed, and the applicant has still not filed proof that she has provided her documents to the respondents.
5In the circumstances, it appears that the applicant has abandoned the Application.
6The Application is therefore dismissed.
