DECISION
Adjudicator: David Muir
Indexed as: Mauch v. Loblaw Companies Limited
1These are two Applications filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment.
2The Tribunal’s records indicate that these two cases were settled at a mediation held at the Tribunal on March 28, 2013. The parties did not execute a Form 25 required by the Tribunal’s Rules at the time of the mediation.
3The parties have been requested to deliver and file an executed Form 25 on two occasions. The respondents delivered and filed an executed Form 25 in respect of both cases on June 11, 2013.
4In a Case Assessment Direction issued to the parties on June 27, 2013 the he applicants were directed to deliver and file an executed Form 25 in respect of their Applications or otherwise indicate their intentions with respect to these Applications within 7 days of the date of this Direction failing which the Applications might be dismissed as abandoned.
5The applicants have not responded to the Tribunal’s Direction above and have not communicated with the Tribunal in any way. I find that the applicants have abandoned these Applications and they are dismissed.
Dated at Toronto, this 12th day of July, 2013.
