Introduction
1By Application dated June 1, 2012, the applicant alleged that the respondent discriminated against her on the basis of family status and marital status when it terminated her employment. By Interim Decision 2013 HRTO 300 dated February 22, 2013, the Tribunal deferred the Application pending the conclusion of an appeal to the Ontario Labour Relations Board filed under the Employment Standards Act (ESA).
2On June 3, 2013, the applicant filed a Request for Order During Proceedings (“RFOP”) to reactivate her Application. In the RFOP, she stated that she and the respondent had agreed that she would withdraw her ESA appeal without prejudice to her right to continue with her Application to the Tribunal. She indicated that the respondent was consenting to the reactivation of the Application. The respondent did not file any correspondence in response to the RFOP.
Order
3In these circumstances, the Application is reactivated. The Registrar shall schedule a two day in person hearing.
4I am not seized of this matter.
