INTERIM DECISION
Adjudicator: David Muir Date: July 3, 2013 Citation: 2013 HRTO 1157 Indexed as: Lavoie v. Greater Sudbury Police Services Board
WRITTEN SUBMISSIONS
Gary Lavoie, Applicant Self-represented
Greater Sudbury Police Services Board, Greater Sudbury Police Service and Frank Elsner, Respondents David Migicovsky, Counsel
1This is an Application filed on May 22, 2012 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in the provision of goods and services on the basis of disability, family status, marital status, age and reprisal. This Interim Decision deals with a Request to reactivate the Application.
2This Application was deferred pending the conclusion of a grievance filed on behalf of the applicant in 2012 HRTO 2039. The applicant has filed a Request to re-activate the Application. The grievance procedure has concluded and the applicant’s bargaining agent has decided not to refer the grievance to arbitration. The respondent takes no position on the request to reactive. In the circumstances I find that it is appropriate to re-activate this Application.
3I am not seized.
Dated at Toronto, this 3rd day of July, 2013.
