1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to goods and services because of disability.

2On May 17, 2013 the Tribunal wrote to the parties and directed that the applicant provide up to date contact information for him as previous attempts to contact him were unsuccessful. The applicant’s attention was drawn to Rule 5.4 of the Tribunal’s Rules of Procedure which provides as follows:

5.4 The Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided to the Tribunal by that person.

The applicant was advised that if he did not provide current contact information on or before May 31, 2013 the Application would be dismissed as abandoned.

3A similar direction dated June 5, 2013 was delivered to the applicant requiring that he respond on or before June 15, 2013.

4The applicant has not responded to either direction and nothing at all has been heard from the applicant for several months despite various attempts by the Tribunal to contact him.

5In all of the circumstances I find that this applicant has abandoned the Application and accordingly it must be dismissed.
