1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging reprisal and discrimination with respect to employment because of family status and marital status.
2In Interim Decision 2012 HRTO 576, the Tribunal deferred further consideration of this Application pending the conclusion of an ongoing civil action.
3On May 29, 2013 the Tribunal issued a Case Assessment Direction (“CAD”) indicating that counsel for the personal respondent advised the Tribunal the parties have resolved all matters between them, including this Application. Counsel provided a copy of the Full and Final Release to the Tribunal.
4The applicant did not respond to this correspondence or otherwise communicate with the Tribunal.
5The CAD indicated that unless the Tribunal hears to the contrary from the applicant by June 7, 2013, the Tribunal will assume that the Application has been settled, withdrawn or abandoned.
6The applicant has not responded to the CAD and the time for doing so has now passed.
7In the circumstances, the applicant is deemed to have abandoned the Application.
8The Application is dismissed.
