Introduction
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of citizenship, ethnic origin and age.
2On April 11, 2013, the Tribunal sent to the parties a Notice of Summary Hearing to be held on June 20, 2013.
3The applicant has not responded to the respondent’s e-mails of April 19, May 6 or 9, 2013 or to the Tribunal’s e-mails of May 3 and 14 or June 12, 2013 attempting to find a mutually agreeable date for the rescheduling of the Summary Hearing.
4The Tribunal advised in a letter dated June 12, 2013 letter that if the applicant did not respond by providing available dates for re-scheduling or otherwise confirm the intention to proceed with the Application by June 19, 2013 it may, pursuant to Rule 5.4, deem the application to have been abandoned and close its file.
5Rule 5.4 states:
The Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided to the Tribunal by that person.
6The applicant has not responded to the Tribunal’s June 12 letter and the time for doing so has now passed. In the circumstances, it appears that the applicant has abandoned the Application.
ORDER
7The Application is dismissed as abandoned.
