Introduction
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in employment on the basis of association and reprisal contrary to the Code.
2In a previous Interim Decision (2011 HRTO 559), the Tribunal ordered the Application deferred pending the conclusion of proceedings underway before the Ontario Labour Relations Board (the “OLRB”).
3On April 18, 2013, the Tribunal received a request from the applicant to reactivate the Application. She has attached copies of the decisions of the OLRB in the two matters before it, including the final reconsideration decision dated February 28, 2013. The respondents have not filed a Form 11 and the time for them to do so has now passed.
4As the requirements under Rule 14 have been met, the Application is reactivated. The respondents must file a Response in accordance with the Tribunal’s Rules within 35 days of the date of this Interim Decision.
5I am not seized.
