On March 11, 2013, the Tribunal issued an Interim Decision, 2013 HRTO 413, wherein it determined that this Application should be deferred pending the conclusion of the criminal proceeding against the personal respondent.
On May 29, 2013, the respondents filed a request to reactivate this Application on the basis that all charges have been withdrawn, thereby concluding the criminal proceeding against the personal respondent. The respondents provided a copy of court records indicating that all counts were withdrawn on May 2, 2013 at the request of the Crown.
The applicant filed response submissions consenting to the request to reactivate.
Given that the criminal proceeding is now concluded, the Tribunal determines that it is appropriate to reactivate this Application. Accordingly, the Application will continue in the Tribunal process.
The Application is reactivated.
I am not seized of this matter.
Dated at Toronto, this 14th day of June, 2013.
