1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of age. The Application indicated that there was an ongoing court action based on the same facts as the Application, and that the applicant has asked the court for a remedy based on the alleged discrimination.
2On March 4, 2013, the Tribunal issued a Notice of Intent to Dismiss (“NOID”) under s.34(11) of the Code because it appeared that the Application is outside the Tribunal’s jurisdiction. It directed the applicant to provide submissions responding to the issues raised in the Notice. The applicant failed to respond to the Notice within the time the Tribunal directed him to respond. The Tribunal then issued a Case Assessment Direction to provide submissions responding to the NOID, or the Application might be dismissed as abandoned.
3On June 7, 2013, the applicant wrote to say he met with “the Human Rights Legal Services” and has decided to continue with his court matter so that he understands the Application will be “withdrawn/cancelled/denied”.
4In the circumstances, the applicant’s request to withdraw his Application is granted.
