DECISION
This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of sex and sexual solicitation.
The hearing of this Application is scheduled to begin on July 2, 2013 and the Tribunal's Notice of Confirmation of Hearing dated January 7, 2013 advised the parties of the steps to take in preparation for the hearing. This included requirements that the parties exchange arguably relevant documents by January 28, 2013 and exchange and file documents and witness statements that parties would rely on at the hearing by May 21, 2013.
As the applicant had not complied with either requirement in accordance with these deadlines, I issued Interim Decision 2013 HRTO 969 [CHRR Doc. 13-1469]. This decision notified the applicant that she had to comply with both requirements by June 7 and June 10, 2013 respectively or her Application could be declared abandoned.
The applicant has not met either requirement and the deadlines for doing so have passed. The Interim Decision was sent to the applicant by email and regular mail on May 31, 2013. I am satisfied that she received it. As the applicant has neither met the requirements nor provided any explanation for her failure to do so, I determine that she has abandoned her Application.
ORDER
- This Application is dismissed as abandoned.
