1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.

2Having reviewed the parties submissions filed in response to the Tribunal’s Case Assessment Direction dated November 19, 2012, I have concluded that there is not a proceeding before the WSIB. Accordingly, the Tribunal will not defer consideration of the Application.

3The hearing set for April 3, 4 and 5, 2013, will proceed as scheduled.
