HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Vernon Lohan
Applicant
-and-
Sylvia Verkerk, Peel Regional Police and Jamie Hinton
Respondents
DECISION
Adjudicator: Naomi Overend
Indexed as: Lohan v. Verkeck
INTRODUCTION
1This Application alleges discrimination with respect to services because of place of origin, citizenship, disability, creed, sexual orientation and marital status contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). It would appear, although it is by no means clear, that the Application relates to events that led to criminal charges and prosecution.
2Sylvia Verkerk is listed on the transcript of those proceedings as the applicant’s defence counsel. The applicant sent to the Tribunal a number of emails from Jamie Hinton, which appear to show that Hinton is a Manager, Compliance and Licensing Enforcement for the City of Mississauga.
3In an Interim Decision, dated September 17, 2012, I dismissed the Application against one of the four named respondents and ordered the applicant to provide further particulars. The applicant responded to this Interim Decision, but did not copy his correspondence to the Tribunal, dated October 9 and 10, 2012, to the respondents, despite repeated warnings to do so.
4On May 8, 2013, the Tribunal wrote to the applicant directing him to provide proof that he had sent to the respondents copies of his October 9 and 10, 2012 emails to the Tribunal. The letter warned the applicant that a failure to respond to the letter in writing by no later than May 22, 2013 may result in his Application being dismissed as abandoned.
5As of the date of this Decision the applicant has not responded to the Tribunal and the Tribunal’s correspondence to him has not been returned.
6In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 5th day of June, 2013.
