1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On April 19, 2013 the Tribunal issued to the applicant a Notice of Intent to Dismiss (the “NOID”) the Application on the basis that it appeared to be outside of the jurisdiction of the Tribunal because it was not filed within one year of the date of the last alleged incident of discrimination.
3The NOID advised the applicant that he had to file written submissions on or before May 21, 2013, and that failure to do so could result in the Application being dismissed as abandoned.
DECISION
4I am satisfied that the NOID was sent to the applicant’s address by mail. As of this date, the applicant has not filed submissions nor made any contact with the Tribunal. The applicant was warned in the NOID that failure to file submissions could result in the Application being dismissed as abandoned.
5In light of the foregoing I am satisfied that the applicant has abandoned the Application.
6The Application is dismissed.
