1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 17, 2010.
2In an email dated October 26, 2011 the respondent advised the Tribunal that the parties had resolved the dispute and no longer required the Tribunal’s mediation process. On April 13, 2012 the Tribunal wrote the applicant to seek written confirmation of the applicant’s intentions with respect to this Application. This email directed the applicant to file either a signed Form 25 (Settlement) or a Form 9 (Request to Withdraw). The email warned the applicant that a failure to respond to the email in writing within ten days might result in the deemed abandonment and subsequent dismissal of the Application.
3As of the date of this Decision the applicant has not responded to the Tribunal and the Tribunal’s email to her has not been returned.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
