1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. The Application was deferred pending Workplace Safety and Insurance Board proceedings by Interim Decision dated January 4, 2011: 2011 HRTO 3, 2011HRTO 3.

2On November 8, 2011, the Tribunal, in accordance with its usual practice, sent a letter directing the applicant to advise the Tribunal, within 30 days of the date of the letter, whether the WSIB proceeding was still ongoing. The Tribunal advised that if the applicant failed to provide an update, the Application may be dismissed as abandoned. The applicant did not respond. The Registrar wrote to the applicant by e-mail on December 15, 2011, reminding her of the November 8, 2011 letter and directing her to advise the Tribunal of her intentions by December 28, 2011. The applicant did not respond.

3In the circumstances, the Application is dismissed as abandoned.
