1The Attorney General for Ontario seeks to intervene in this Application, which challenges the validity under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, of certain sections of the Workplace Safety and Insurance Act, 1997, S.O. 1997, c. 16, Sched. A. The other parties have not filed submissions on this Request. The Attorney General evidently has an interest in this issue, and leave to intervene is granted.
2The Attorney General submits that the Application should be deferred pending the decision of the Workplace Safety and Insurance Appeals Tribunal (“WSIAT”) in file 2006-1939. The Tribunal seeks written submissions on the issue of deferral from all parties and will decide whether the Application should be deferred based on these written submissions. The submissions of any parties supporting deferral of the Application must be filed within two weeks of the date of this Interim Decision. The submissions of any parties opposing deferral of the Application must be filed within four weeks of the date of this Interim Decision.
