1This is an Application, filed on August 16, 2010, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination and harassment in employment because of race, place of origin, citizenship and ethnic origin.
2In a previous Interim Decision in this matter, 2012 HRTO 488, I found the applicant had pointed to sufficient evidence to avoid a finding that the allegations of racial harassment in his Application had no reasonable prospect of success. I dismissed the remainder of the Application. I noted, however, that most of the surviving allegations were untimely. Consequently, I directed the applicant to file submissions particularizing when he was subjected to racial harassment and to explain why these allegations are timely pursuant to sections 34(1) and 34(2) of the Code within 14 days of the date of the Interim Decision, which was March 7, 2012. As of the date of this decision, the applicant has not complied with this direction.
3In the circumstances, I find the applicant has abandoned the Application and in any event provided no basis on which I could conclude the surviving allegations are timely.
4The Application is dismissed.
