1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on September 30, 2010.
2On March 12, 2012 and March 19, 2012, the Tribunal wrote the applicant to seek written confirmation of the applicant’s intentions with respect to this Application and to confirm a March 2, 2012 a telephone conversation between a Tribunal staff member and the applicant, in which the applicant indicated she intended to withdraw the Application. The letter of March 19, 2012 asked that the applicant confirm her intention to withdraw by filing with the Tribunal and copying to the parties a Form 9 (Request to Withdraw) and Form 23 (Statement of Delivery). The letter stated that a failure to respond to the Tribunal’s letter in writing by April 2, 2012 might result in the deemed abandonment and subsequent dismissal of the Application.
3As of the date of this Decision the applicant has not responded to the Tribunal and the Tribunal’s correspondence to her has not been returned.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
