BACKGROUND
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on February 2, 2012, alleging discrimination in employment due to reprisal or threat of reprisal.
2The applicant was sent a Notice of Intent to Dismiss (NOID) by the Registrar on March 1, 2012, which advised that the Application appeared to be outside the Tribunal’s jurisdiction on the following basis:
The Application alleges discrimination based on reprisal but has failed to explain how the respondent’s behaviour was related to any of the following: claiming or enforcing a right under the Code; instituting or participating in a proceeding under the Code; or, refusing to infringe the right of another person under the Code.
3The NOID further advised the applicant that he must file submissions responding to the issues identified in the NOID by March 31, 2012, or the Application may be dismissed as abandoned.
4No response to the CAD, or any other correspondence, was received by the Tribunal from the applicant, and the time for doing so has passed.
ANALYSIS
5In the circumstances, the applicant is deemed to have abandoned the Application.
ORDER
6The Application is dismissed.
