BACKGROUND

1This is an Application filed June 7, 2011, pursuant to section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The applicant alleges discrimination with respect to employment because of disability.

2The respondents filed a Response on September 30, 2011, requesting deferral of the Application pending the outcome of a workplace grievance arbitration process.

3The Tribunal granted the request to defer on November 14, 2011.

4On March 5, 2012, the applicant filed a Request for Order During Proceedings, seeking reactivation of the Application because the grievance arbitration process has concluded January 31, 2012, with a settlement agreement.

5On March 20, 2012, the respondents advised that they did not oppose the reactivation of the Application.

ORDER

6As the respondents do not oppose the request, the Application is reactivated.

7I am not seized of this matter.
